Magic Cubes (the “App”) is published and licensed to you by Eugene Kugut (“I”, “me”) under Apple’s standard Licensed Application End User License Agreement (the “Standard EULA”). These supplementary terms describe purchases, services and contact information for the App. They apply alongside the Standard EULA and do not replace or amend it. If there is any conflict, the Standard EULA prevails. Your rights under mandatory law are not affected.

1. License and ownership

The scope of your license, permitted use, restrictions and termination are governed by the Standard EULA and the Usage Rules in the Apple Media Services Terms and Conditions applicable to you, including any permitted access through Family Sharing or volume purchasing. These supplementary terms impose no additional restriction on that license. The App, its code, 3D models, music, graphics, name and related rights belong to me or my licensors. Nothing here restricts uses permitted by mandatory law or by the licenses of any open-source components included in the App.

2. Free use, ads and purchases

The App is free to download. Without Premium, it may show ads as described in the Privacy Policy. Optional purchases are available through the App Store:

All payments are processed by Apple; I do not receive your payment card details. Before confirming a purchase, review the App Store offer for the price, currency, subscription period, any trial or introductory offer and the price payable after that offer ends. Availability and eligibility may vary by account and country or region.

Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. To avoid a charge after a free trial, cancel at least 24 hours before the trial ends; otherwise it converts to the paid subscription described in the offer. You can manage or cancel subscriptions in Settings → your name → Subscriptions on your device; see Apple’s cancellation instructions, including any country-specific rules. Subscription price changes are subject to Apple’s rules and applicable law, including any required notice or consent.

You can request a refund for an App Store purchase through Apple’s refund service. Eligibility depends on Apple’s rules and applicable law. This process does not limit your statutory rights or remedies, including those relating to faulty or non-conforming digital content.

3. Third-party services

The App uses third-party services for analytics and advertising, and Apple services such as Game Center. How they handle your data is described in the Privacy Policy. Their own terms apply to them.

4. Your responsibilities

Keep your device secure. Changes to its security, such as jailbreaking, may affect the App’s reliability. Do not use the App unlawfully or fraudulently manipulate purchases, advertising interactions or Game Center features. Exercising your privacy choices is not misuse of the App.

5. Availability and changes

Some features, including ads, purchases and Game Center, need an internet connection and depend on third-party services. Updates or changes may be needed for security, maintenance, compatibility, legal compliance or improvements to the App. Any such change must respect the Standard EULA, applicable law and the rights associated with your purchases.

Your purchases remain subject to the entitlements, duration and conditions presented when you bought them. These terms do not authorize arbitrary removal of paid content or shortening of a paid access period. A change or discontinuation that adversely affects paid access is subject to any legally required advance notice, consent, right to terminate and refund or other remedy. Changes to prices for new purchases do not alter completed purchases.

6. Warranties and liability

The warranty and liability provisions of the Standard EULA apply, subject to mandatory law. Nothing in these supplementary terms excludes or limits liability that cannot lawfully be excluded or limited, or deprives you of mandatory consumer rights or remedies.

7. Changes to these terms

I may update these supplementary terms to reflect changes in law, security requirements or the App’s services. The date at the top identifies this version. Material changes are subject to any notice and agreement required by applicable law before they apply. Updates do not retrospectively reduce your rights under existing purchases or amend the Standard EULA. Continuing to use the App does not waive your mandatory rights.

8. Governing law

These supplementary terms do not change the governing-law or jurisdiction provisions of the Standard EULA. For matters outside the scope of those provisions, the governing law and competent courts are determined by applicable law. You retain all mandatory consumer protections and any rights to bring proceedings in your country of residence that cannot be excluded by agreement.
